Temporary (borrowed) business relationship

Developments in the field of technology and competition in the international area has also affected business life as it did in several areas. These developments has revived the flexibility phenomenon in business life and provided new business relationships to arise based on flexibility. One of these new business relationship examples is the temporary (borrowed) business relationship which means the right of request for being done of the job is given to another employer temporarily without ending the agreement between the employee and the employer being depended on with a business agreement. The temporary (borrowed) business relationship has been applying since 1960s in our country and since the articles of Business Law No. 1475 could not meet the needs oriented to this relationship, it has had a legal arrangement with the Business Law dated 10th June, 2003 and numbered 4857 by means of legislation studies within the context of adaptation process to European Union. There are not many court decisions and case laws about this issue since the temporary (borrowed) business relationship is an institution which had a legal arrangement ne'Yly. In this study, the flexibility concept has primarily been discussed together with its reasons and results. Afterwards, the definition of temporary business relationship has been made and by determining its differences from similar legal concepts, founding conditions, legal results it may lead to,ending conditions and the results of contradiction with temporary business relationship arrangements have been argued. In addition, it has been tried to present suggestions for solutions to problems encountered in business life related to the subject. In this respect, legislations articles, written books, articles, and court decision about the issue have been researched. The conclusions arrived at the end of the research done have been evaluated in the form of benefits of actual employer, temporary employer, and the worker who placed inside the said triple relationship.Key Words1.Flexibility2.Employer3.Employee4.Temporary5.Borrowed
