Özet (EN)

Maritime claims which rise upon operating of the ship secured by the lien which is called maritime lien. Maritime liens arise as a result of contractual relationships (such as seamen?s wages or masters? disbursements), but maritime liens can also arise tort, such a collision or damage, and in noncontractual situations. Therein maritime liens can arise from different sources. On the other hand, maritime liens arise automatically, without any antecedent formality and once executed, date back to the time of the incident giving rise to the maritime lien and arise without the holder of the lien ever obtaining possesion of the subject of the lien. These features of the maritime liens provide obvious advantages to the lienholders. In order to take in advantage of maritime lien, the lienholders (creditor) schould apply to the procedure of the enforcement lien. In this procedure, (if the creditor does not satisfied by the depositor) the execution office attach to the subject of maritime lien and sell it. In this study, how to enforce maritime liens under the enforcement law order will be examined. In this way, how to benefit from the security which is provided by maritime liens will be exposed. Within this framework, general information about maritime lien and enforcement of lien will be given in the first chapter of the study. In the second chapter we will emphasize the features of the enforcement of maritime liens under the enforcement law. The analysis of the procedure which schould pursuited by the lienholder (creditor) will be examined in the third chapter. The procedure of sale of subject of maritime lien (especially sale of ship) will be evaluated in the last chapter.
