Examination of security investigation and archive research according to the human rights and protection of private life

The Security Investigations, that did not find any legal ground until 1994 and tried to be placed on a legal basis with In Law No. 4045; "Security investigation, the law on the revocation of the rights of those who have not been dismissed for some reason, In law no. 1402; law on amendments to martial law" that accepted in 26.10.1994 and published in the official gazete on 03.11.1994. Security investigation and archival research have started to take more places in our lives and expanded its scope by governments which has undergone many changes since that time line. The scope of the investigation that only includes the officers who involved in the critical roles has been enlarged and nowadays, almost every public officers has start to appear as a main selection element of recruitment or migration between institutes. In this study, the concept of the security investigation and archive research will be discussed, which methods will be evaluated by whom, the benefits and disadvantages will be discussed. In addition, it will be focus on the concept of "being objectionable", the subject of security investigation and archival research will be evaluated in terms of judicial decisions and jurisprudence, also will be examined in depth in terms of human rights conflicts. The Council of State's judicial decisions will be discussed about security investigations will be examined with their reasons. In the new world, which is becoming more and more complex with technological developments and globalization, the nessesity of employing appropriate officers for the porposes and methods of the states will be discussed and the issue will be discussed in the context of the information security and counter-intelligence.
