The situation and results of unfair competition

Entry into force in 01 July 2012 that the law no is 6102 of TCC most frequently encountered on of the violation cases is unfair competition provisions. Based on honest and unspoiled competition and unfair competition provisions based on the principles of respect for labor are important to state that it is of vital importance in commercial life. Our work mainly consists of three main sections. In the first part definition of unfair competition, comparison with old TCC, similar concepts like unfair competition, comparative law and development in our country law, comparison of unfair competition with other legal disciplines, terms and conditions are examined. In the second part , each unfair competition situation in the TCC has been examined one by one.In the third and the last part will be opened lawsuits, legal, criminal sanction and private international law have been examined. In the thesis, it has been seen that the contents of the former Turkish Commercial Law which has been abolished from the enforcement are not separated very much and contents have been enlarged and new cases have been added. It will be difficult for some of these new additions to be for find a body in application and the extent to which some of those additions will provide protection against evolving technology is doubtful. Nevertheless, it was concluded that the provisions of unfair competition can not be regarded as only being regulated by TCC and independent of other laws, and therefore it would be more appropriate to regulate the law enforcement officers as a single law in order to facilitate their work.
