Doctor's professional liability insurance

The duty of a doctor who is the operator of medical science is to diagnose and treat the illnesses. Doctor makes some sort of interventions for his patient to make him beter as healthy as in the past. While the aim of the medical intervention is the healing of the patient, sometimes unwanted results may ocur such as; the patient may die or get injured. The liability of a doctor is mentioned in this case. In the past, there weren?t so many cases against doctors. Because, it was a general belief that they were performing a sacred profession. But today, it has been accepted that they can be sued like other professions if they do not perform their profession properly.The development in the law of liability and the legal liability of a doctor, the increase in the quality of compensation demands against doctors enhanced the need to doctor?s professional liability insurance which is an under branch of liability insurance. Doctor?s professional liability insurance and his liability rising from private law as a result of his professional activity are taken under the protection of insurance.In spite of the developments of the insurance of liability, it hasn?t been put in to an order in another part in Turkish Trade Law, judicial decisions related to insurance of liability took place disorderly and inefficiently. General conditions of professional liability insurance and doctor?s professional liability insurance clause as the attachment of general conditions were published and came into force to relieve the futility in the regulations and meet the needs. While it is not suggested with these regulations that the doctors must do professional liability insurance, it has been a necessity for the doctors to get professional liability insurance with the twelfth clause which is attached to the 1219 marked law.The aim of this work is to explain the system that is available now and its problems in the area of doctor?s professional liability insurance which is made necessary for the doctors who perform their profession although it has been a sort of insurance that is newly practised in our country.
