Özet (EN)

It is an inevitable fact that there will be differences of opinion since the existence of humanity. Whatever the subject of the dispute is, leaving citizens to settle their disputes without a control mechanism can cause social problems. Therefore, as one of the three main powers of the state, judicial power aims to ensure justice in accordance with the laws in force and the dictates of social conscience. In the resolution of disputes based on private law between the parties, there is a need for the judgment of civil courts. As it is necessary to follow a certain procedure in civil procedural law, in the event of non-compliance with these rules, the court makes decisions that rest upon procedural grounds. In addition to this, in full compliance with these certain procedural procedure, the courts make decisions that rest on the merits of the case. In order to achieve either a decision on procedural grounds or a decision on the merits, some interim decisions are also needed in order to take the case forward. Moreover, in order to protect the matter in dispute, the need for interim measures is undeniable. This study aims to analyze the recent jurisprudential developments by evaluating all these decision types that could be made in civil courts as a whole. Keywords: Decision, decision based on the merits, interim decision, interim measures, recording of evidence.
