Ibn Hazm's al-Muhallâ forensic seism of the opinions given to Imam Shafiî arbitration (Family Law example)

Abstract (EN)

İbni hazm who considered the second imam of zahiri school of thought died in the year 456/1064. He has written several books and one of them being "almohalla". He is not only considered the views of Zahiri school of thought but has taken into account İmaam Shafii and many other scholars. İn this article we will detect and verify the views that has been attributed to imam shafii. This article has an introduction, two sections and a conclusion. İn the introduction part, the importance and the purpose, the method and sources of thesis are mentioned. İn the first part, the information about İbni Hazm and Zahiri school are mentioned. İn the second part, the family law in al-Mohalla and the views that has been attributed to imam Shafii are analysed and verified. Whilst looking into the views of İmam Shafii the sources of this school were examined. As a result 150 of them turned out to be accurate and 7 of them turned out to be incorrect.
