The main difference between this Article and the articles which refer the crime of bid rigging in Turkish Penal Code 765 is that Article 235 of the Code No. 5237 sets forth the conducts of bid rigging as optional. However, it is clearly seen that the lawyers and the practitioners have some hesitations about how to apply the Article. Morever, Article 235 of the Turkish Penal Code was amended by Article 12 of the Law No. 6459 and became a result crime that causes damage.
