Unfair competition by a way of confusion

In a world where the competition is getting harder, the economy is globallizating, huge multinational companies are appearing, the technology is rapidly growing, persons and establishments will not always act in goodwill, ethic and legal for the reason to be exist, to grow up, to progress. The most seen act of unfair competition that persons and establishments rarely commit is, to use identification instruments such as name, trade name, trademark and sign to make confusion with the identification instruments such as name, trade name, trademark and sign that one use fairly. To benefit from the fame and credit that one person or an establishment gain in the society after long time period, serious practices and huge capital illegally is the easiest way of doing business without effort and endeavor. Confusion, the most seen act of unfair competition usually is made on trademarks. For the reason of the value of a trademark an establishment have is approximately one billion dollars and the importance of having a trademark, leads persons who are malicious and want to get something without any effort and endeavor, firstly trademark piracy. With the development at the economy, technology and competition, it is not deemed sufficient in our legal system the general provision for unfair competition in Commercial Code but international agreements are ratified, new codes and decrees are enacted to fight against unfair competition. We try to search the general provisions in Turkish Commercial Code regulates confusion and the relation between the general provisions and special codes and decrees in this thesis named unfair competition by a way of confusion.
