An analysis on judicial audit criteria in zoning plan modifications: Izmir experiences (2018–2023)

Zoning plan changes are an "administrative saving" and must comply with the law in terms of authority, form, subject, reason and purpose. From this point of view, it is expected that the zoning plan changes will comply with the laws and regulations in the legal context. Therefore, the main requirement for zoning plan changes is to comply with the Legislation. Other requirements should be considered as a Public Benefit with Planning Principles–Urbanism Principles. The aim of this research is to analyze the zoning plan changes in all central districts of Izmir Metropolitan Municipality in terms of subject–scope and content within the scope of archival scanning/ database research and oral interviews related to administrative judicial decisions, conceptual and institutional knowledge, and legislative requirements, and to question the "judicial audit criteria" related to zoning plan changes. More clearly, the work to be done in this study is to create a conceptual–institutional and legal background judicial audit criteria guide for plan changes at the level of the general and applied zoning plan, which have been subject to the administrative judicial process in the context of the central districts of Izmir Metropolitan Municipality. In the continuation, based on this guide, the evaluation of zoning plan changes in terms of subject–scope–content / function, authority–responsibility difference and spatial distribution at the district level. These assessments dynamics of the Central District of Izmir Metropolitan Municipality Metropolitan detection of urbanization, Urban Development, spatial functional prediction of the nature and development trends–prediction in terms of city planning is believed to contribute to the efforts.
