This study aims to examine the relationship between violence against women and gender inequality from the perspective of human rights law. In the first chapter, the concept of gender and the dynamics of inequality shaped around this concept are discussed, revealing how the patriarchal system constructs gender roles. The reinforcement of these roles through social structures such as education, family, religion, culture, and media is analyzed, and the ways in which gender-based discrimination lays the groundwork for violence against women are evaluated. The second chapter addresses violence against women as a violation of fundamental human rights, analyzing the historical evolution of women's human rights in international law. The study evaluates how international organizations such as the United Nations and the Council of Europe, along with the recommendations of the CEDAW Committee, have addressed violence against women within the framework of international law. Furthermore, it emphasizes the state's positive obligations in preventing violence and argues that violence against women should be considered an independent human rights violation in its own right. The third chapter examines legal regulations and practices in Turkey regarding the struggle against violence against women. Within the framework of the Istanbul Convention and Law No. 6284, preventive and protective mechanisms, support services, and judicial decisions are analyzed to assess the current situation. In conclusion, the study discusses the effectiveness of legislation, identifies shortcomings in practice, and offers recommendations from a human rights perspective.
