Job security and termination of labor contract due to operational reasons

The subject of our thesis is "Job Security and Termination of Labor Contract Due to Operational Reasons". The purpose of the study is to examine the job security system, termination of labor contract due to operational reasons, which are among valid termination reasons according to job security system, and fundamental principles required to be considered in terminations due to operational reasons. Our thesis is composed of three sections. The first section is explained termination of labor contract and termination types in general. The second section is examined the job security and field of application of the job security provisions. This section is defined international sources of job security, ILO Convention No: 158 under a separate title by considering its effect especially during the process of preparing our Labor Law No: 4857, and national sources of job security. Furthermore, since provisions of the job security can not be applied to all businesses and workers, there are examined application field of the job security provisions. The third section is discussed termination due to operational reasons, which are among valid termination reasons. In this section primarily is explained the concept of valid termination and makes explanations about the concept of termination due to requirements of business, workplace and job, which are among valid termination reasons. The concept of operational decision sought in terminations based on requirements of business and the control of this operational decision by courts are examined. Then we explained the termination of labor contract caused by reasons other than the operation of vii business, workplace and job, and examples encountered during the application with court decisions. The final part of the third section is explained principles applied in terminations due to requirements of business, workplace and job in the application of labor law with court decisions.
