Abstract (EN)
Mediation is a system used in our country's geography as a resolution that dates back to very old time. As of 2013, this system became lawfull and announced its name offically within our borders. This system, which has become widespread every day, first appeared in optional legal disputes, but it has become the case requirement when it shows 2018 for years. The mediation as a case condion was first evaluated in disputes arising under labor law and after high success rates, it has started to become widespread in other areas where there are other legal disputes. Considering the judical workload of our country, the intensity of the labor law has been alleviated with the mediation system. In our thesis, besides World applications, we will talk about the how this system benefits our national judical network, the diffuculties experienced in the early days due to system change, advanteges that both parties have for winning and the all details regarding the medition process. It will be correct to introduce the mediators regarding the issues and the process under consideration to this service as a formal service, and to publicize it as an advertisement if necessary. In addition, the education received by everyone in this system according to the relevant specialization area should be increased. It will be benefical for the judges to get education in this context, especially after mediation as a case condition, to act as a mediators in the process and make the parties understand.
