Abstract (EN)

The concept of equality which is in close relations with the concept of justice is a general policy that applies to the all legal areas; also it aims to remove discrimination based on the rights and opportunities in social life between the individuals. Because of its importance the concept of equality is one of the most focused and discussed concept in terms of philosophy of law during all the phase of the history. However, discrimination in social life exists from the beginning of humankind due to the being social individuals. This discrimination is result from the physical, spiritual or social status of people.Whereas the employee, who is in a weaker and in effective position before the employer and other side of the employment contract, is obliged to work in order to survive; it is important for the employee as well as the society that he/she lives in, that the employer treats equally while the employment contracts are terminated by the employer. Otherwise, the employer may terminate the employment contract in bad faith and therefore the employee began to become like one kind of servant. So the employees needed to be protected from this kind of terminations behaviors. One of the ways to achieve this goal is limiting the employer?s authority in scope of the principle of the equity.
