İstihsan in the Methodology of Islamic Law

This thesis consists of an introductory chapter, three main chapters and a concluding chapter.The introductory chapter lays down the general frame of the thesis and research methodology.Chapter I focuses on the conceptual framework of İstihsan. In this context, It is taken the definition of İstihsan, its historical development and examples of application in the period of Prophet, Companions and Followers.Chapter II deals with the views of the school on the İstihsan and the relationship with other evidences.Chapter III deals with the approaches of the contemporary usul scholars. It is taken also solving modern problems with the using İstihsan.At the conclusion of the study we have reached as a result are expressed in points.Key Words: The Methodology of Islamic Law, İstihsan, Kıyas (Analogy), equity, kontranology
