The situation of the disabled in islamic law

According to Islam religion, the Prophet Âdem who was created by God?s own hand and carried God?s soul was not disabled. But the same thing can not be said about his children who were born after his passing from heaven to the earth. Consequently the history of these special people who we call ?disabled?, ?paralysed?, ?handicapped? and ?person who needs special care?, the subject of our research, goes back to the first period of human history. These people who became disabled due to various reasons, suffered a lot in all periods of time when there weren?t any right, law and justice. These sufferings have contiued recently.But in the last century some concepts like human rights, freedom and democracy which are being more and more important have gained a social dimension. With the help of those pleasing developments the view to disabled people has also changed positively.Considering that there are 500 millions of disabled people living on the earth we can see there is still a long way to take. It is very while we consider wars, terrorism, traffic, alcohol, drugs, work accidents caused by man himself as well as natural disasters such as earthquakes, flood, fire, it is guite obvious that its religious, social, economical, political and legal aspects should always be kept in the agenda and that solutions should be found to it.In our study, we tried to issue a subject, an important and mainly human rights subject that has never lost its importance, according to Islamic Law by considering the history of disability as well.What is the point of view of Qu?ran and the Sunna, the main sources of Islamic Law about disabled people? Has Qur?an mentioned about disabled prophets? How were the disabled people treated in the time of Prophet Mohammed? According to Qur?an and the Sunna what are the reasons of being disabled? What kind of advantages and obligations have Usulî and Fıkhî rules concerning the disabled, brought to them? Have Islamic Law scholars talked about disabled people? We tried to get answers to above mentioned questions.Key words: Islamic Law, Right, Disabled, Obliged, Worship.
