Misdemeanor and a crime distinction

In our thesis titled "Misdemeanor and Crime Distinction", what the concepts of misdemeanor and crime are, the differences between misdemeanor and crime, and the jurisprudence of the Constitutional Court and the European Court of Human Rights on this issue have been examined. In the first part of our thesis, how the concepts of "misdemeanor" and "crime" are defined and understood in doctrine and judgment are examined; Subsequently, it was explained how the misdemeanors that were seen in crimes in the past were taken out of the concept of crime in the world and in our country and gained a separate legal structure. In addition, the theories put forward in making the distinction between misdemeanor and crime were examined. At the end of the first part, it is explained how the distinction between misdemeanor and crime is beneficial especially in practice and judicial activities. In the second part of our thesis, some basic issues are mentioned and how these issues are organized in terms of misdemeanors and crimes are examined. Among these issues, the ones that can be used in the distinction of misdemeanor and crime have been accepted as criteria for the distinction of misdemeanor and crime, and the reason for the acceptance of this criterion and how it can be used is explained. In addition, some issues discussed by the doctrine and the judiciary on fundamental issues that are important in terms of misdemeanor and crimes were emphasized, opinions on this issue and finally our opinion were also explained. While trying to explain the topics in our thesis, the jurisprudence and various decisions of the Constitutional Court and the European Court of Human Rights on the discrimination of misdemeanor and crime are also explained and analyzed, and its importance is emphasized.
