Assignment endorsement in the bills of exchange

Endorsement is divided into three groups as assignment endorsement, procuration endorsement and endorsement of pawn. As the procuration and assignment endorsement are broad and comprehensive subjects which can be a subject for a separate study, these subjects are not included in this study. Within this framework, the subject of our thesis is the "Assignment Endorsement in the Bills of Exchange." In this study, the discussions in the doctrine and in practice and reached conclusions related to the assignment endorsement in the bills of exchange are examined. The aim of the thesis is to evaluate the implementation, functions and provisions of the assignment endorsement in the bills of exchange in consideration of the negotiable instruments theories and the procedure. The study consists of three main parts. Firstly, as the bill of exchange is a type of negotiable instruments, the concept of bill of exchange, the common specifications of the bills of exchange, the transfer and acquisition modes are explained in the first part after briefly mentioning the concept and specifications of the negotiable instruments. As the assignment endorsement is the main subject of the study, this subject is included in the second part, the center of the thesis. In this part, the definition, legal nature, quality and specifications, conditions, realization modes of the assignment endorsement are examined with reference to doctrine and Supreme Court decisions. In conclusion, the terms and results of assignment endorsement are explained in the third part and the study is completed. The Supreme Court decisions regarding the endorsement and the controversial ideas in the doctrine are emphasized with the thought that the study would also be useful in terms of implementation. Thus, the problems related to the assignment endorsement in the bills of exchange are tried to be concluded by examining in terms of theory and practice.
