Abstract (EN)

Ombudsman service is a peace maker between public authorities and citizens. This service takes a complaint from victim investigates and solves problems about conducting in justice of public services. Ombudsman service is a discussion topic due to cancelling by constitution court in Turkey in 2006. Introducing ombudsman law by number of 5548 does not an obstacle for Supreme Court. After referendum is accepted on september12 in 2010 studies about ombudsman law are continuing legally public opinion have serious expectations for ongoing studies about ombudsman service Instead of making binding decisions, recommending is a major characteristic of Ombudsman institutions. Ombudsman institutions have indirect power over public administration for these decisions to be considered. In addition to the Ombudsman's indirect power, the implementations of recommendations vary according to the characteristics of the administrative system such as the level of democratization and rule of law. The compliance of public administration to Turkish Ombudsman Institution's recommendations is discussed in this article. The legal and administrative obstacles of an effective Ombudsman in Turkey are examined only according to the implementation of recommendations. The main obstacles of implementations are administrative culture and legislation. The voluntary incompliance generally originates from bureaucratic culture while in some other cases presence of an attitude towards compliance may be precluded by incompatible legislation. Ombudsman service is an inspection mechanism between citizens and managements. This mechanism defends rights of citizens across to managements. Ombudsman service is well known service in Turkey although it is made applicable in Sweden firstly. Ombudsman service is applied in many countries, and therefore service is defined by different forms. Ombudsman services according to their countries give form to their society, politics and culture. I used some information about this topic from different magazines, books, internet sites, and academic studies. Studies about ombudsman service in Turkey both social and academic area have begun in 1970's ongoing studies continued to introduce law in 2000's My aim is that, this study wills be in literature of law and help researchers for ombudsman service's activities.
