Medical genetic analyses: personality right viewpoint

Genetic analyses, which reveal human genome information, make it possible to access effective and important data related to individuals? health and life expectations. These data also include information about an individual?s physical and psychological characteristics, which determine one?s expected health conditions in the future, are considered part of private life matters. Therefore, disclosure of that information may cause discrimination and violation of personality rights regarding insurance issues or in work places. Moreover, genetic material, which will be used in genetic analysis, should be distracted from the person?s body. Thus, this process may create a violation in terms of body privileges.Violation of personality right as a result of widespread use of genetic testing and analyses created a need for a legal framework on this issue. It is essential to determine the legal conditions and enforcements that may be required in the cases of lawful and unlawful applications of genetic analyses. This study aims to provide a needed framework for the regulations regarding genetic analysis issues in Turkish Law System considering the principals reported in international documents and the regulations especially in Swiss and German Law Systems.
