Abstract (EN)
People have used dyes,ointments and scents since past ages to look better,younger and to close up their various flaws. These products which were mostly obtained from plants were used by women and men according to the differences brought by the age, symbolizing power or upper class. Over time, these products have been called cosmetics, and have changed their usage areas and contents with changing human needs. In this way, more and more people began to use these products and they have spread. Along with increasing consumption, cosmetic production has moved from small enterprises to factories which brought the process of branding.Especially in the early days, while cosmetics are continued to be preferred, the content of cosmetics changed and began to be composed of different chemical compounds rather than plant roots. Today, the cosmetic product market is one of the main consumer products,but also has a large market share in the global world economy.Cosmetic products that have managed to make such a big place for themselves in the economy, have stopped being only applied to the hair and face, rather started to be applied to the whole body which has been driven by the idea of better treatment and better appearance that increased the ares of use. In fact, in the daily life, we come into contact with multiple cosmetic products such as liquid soaps, toothpastes, deodorants, shaving foams, shaving lotions. The intense contact with cosmetic products and the presence of many users in the world has increased the incidence of various adverse effects of the product.In particular, the chemicals contained in the product component cause both various diseases, especially cancer, as well as the specific situation of the user or the manufacturer, the seller or implementer, result in the injuries. It is necessary to determine whether cosmetic manufacturers, their sellers and their practitioners are responsible for the damages arising from utilization of cosmetic products for protection of the victims and eliminate their grievances, and to designate the conditions for compensation. In consequence, in our study, the characteristics of cosmetic products will be determined and the differences between the products such as drugs and cosmeceuticals which are similar to cosmetics will be determined. Afterwards, in the light of the Turkish Code of Obligations and the amendments to the Law on Consumer Protection, the responsibility of the cosmetic manufacturer, the seller and the implementer, the qualification and conditions of these responsibilities will be examined.
