Abstract (EN)

This study analyzes a comprehensive chronological proceedings of delimitation law. To reflect all delimitation issues, from the beginning of delimitation studies since International Law Commission Sessions before 1958 Conference, 1958 Continental Shelf Convention and 1982 UNCLOS has been evaluated and especially delimitation of maritime boundaries studied as a case law. Two major rules and principles of delimitation issues analysied carefully and decisions of ICJ and international tribunals are evaluated to express equitable principles and relevant circumstances. East Mediterranean Coastal Nations set a limit to Continental Shelf And Exclusive Economic Zone via bilateral and multilateral treaties. With regards to this situation, it is important that Türkiye must determine the thesis related to possible Continental Shelf and Exclusive Economic Zone boundaries. Up to now, 18 law decisions which related to disagreement about maritime baundaries limitation (Exclusive Economic Zone, Continental Shelf) have been made. These decisions form spesific principal and methods which explain general limitation principals. Besides, because of similarities between related areas and East Maditerranian these decisions include matters related to maritime jurisdiction areas. The study analyzes the respective positions of the littoral states including Turkey with regard to the delimitation of maritime zones taking the significance of Cyprus and the value of Eastern Mediterranean in historical, strategic and economic aspects into consideration. This study analyzes the Exclusive Economic Zones within Mediterranean and assesses the possibility of concluding an international agreement between Turkey and Libya. Through such treaties Turkey will be able to assert a new map of maritime areas in Eastern Mediterranean in accordance with its own rights and interests enshrined in international law. In this context; taking into considiration, international law rules and decisions that related to limitation of Continental Shelf and Exclusive Economic Zone and whole special situations; worked on how limitation can be made that suitable for Türkiye's thesis and equitable principles.
