Disputes in logistics sector and mediation

The Logistics sector is rapidly developing in the world as well as in our country and becoming an important part of the economic system. Since it involves both many activities and has relationships with direct manufacturing, marketing and international trade companies. It has a wide network of interpersonal, intercompany or between persons and companies. For this reason, it encounters disputes and conflicts intensively for every logistics activity. Those who work in logistics sector, employers and companies have an important place in the implementation and development of mediation methods since they are included in the mandatory mediation process for both the Labor Law and the Trade Law. Therefore, in the first part of the thesis, the definition of logistics, a brief historical development and logistic activities will be explained. Today, people apply to alternative dispute resolution methods besides judicial authorities in order to solve the disputes. One of the most common alternative resolution methods that is applied and preferred in our country is mediation. For this reason, in the second part of the thesis, the historical development of mediation, the ways of implementation of mediation in other countries of the world, the mediation process as well as cause of action mediation and voluntary mediation will be explained. Since the mediation applications will be examined specifically in terms of the logistics sector within the scope of the thesis, it will detail the issues and principles of the application of mediation method in logistics sector in the third part of the thesis.
