Issues where the Mâlikî madhhab differs from the people in the field of Islamic Criminal Law

This study, which deals with the views of the Māliki sect in the field of Islamic Criminal Law, consists of an introduction, conclusion and three chapters. In the introduction, the purpose of the thesis, method, sources and concepts related to the subject of the thesis are discussed. The first chapter is titled "Definition and Classification of Islamic Criminal Law", the second chapter is titled "Hadith Punishment", the third chapter is titled "Retribution and Diet Punishment", and the fourth chapter is titled "Ta'zir Punishment". In the introduction part of the study, the subject of the thesis, its purpose and the sources utilized are mentioned. In the first chapter, which aims to reveal the definition and sanctions of Islamic Criminal Law, after a general definition of Islamic Criminal Law, the classification of the sanctions determined in Islamic Criminal Law against the crimes committed is discussed in general terms. In the chapters titled Hadd Punishment," "Kısas and Diyet Punishment" and "Ta'zir Punishment,"which constitute the main body of the study, the identification of the crimes and criminal sanctions that the Māliki sect disagreed with the republic on the crimes of hadith, short and diet and ta'zir were tried to be discussed.
