Since the industrialization process, the competitive environment has changed many marketing and sales rules in commercial life, and the desire to make a difference in the market for goods and services providers and to be recognized by the majority has come to the fore. Meantime the acquisition of trademark rights, has revealed the need for effective protection and need for them to be secured. In order to reduce the economic security provided within the context of private law and to increase deterrence against violations, some measures were taken in terms of criminal law. In the thesis, the development of trademarks through history, the general principles of trademark law, elements and criminal acts against the rights of the trademark, which will be subject to criminal law sanctions are examined. Trademark crimes were investigated within the scope of existing Industrial Property Law No. 6769, and High Court decisions and the evaluations of the case were assessed in this context and the subject was tried to be examined in all aspects.
