Temporary agency work

Temporary agency work is, as a rule, the recruitment of workers to employ in another employer's work place. There is a triple relationship in temporary agency work between private employment agency, temporary employees and user firm. There is a labour contract between temporary employee and private temporary agency and the subject of this contract is establishment of a temporary agency work. In Turkish Law, temporary agency work is legalised the first time with the amendment made in the Article 7 of the Labor Law and relevant articles of Turkish Labor Institution Law by Amendment Law no. 6715. The legislator has limited as to temporary agency work and has also included important provisions on the rights and obligations of the parties. The European Union's Directive 2008/104 / EC was taken into consideration while legal regulation was been carried out. In this context, comparing the new regulations introduced in Turkish law with the regulations in international law (especially German Law), the main purpose of our study is to determine whether the regulations are sufficient. Our study consists of three parts. In the first part, the basic concepts of the temporary agency work and the historical development of the temporary agency work will be examined. In the second part, the temporary agency work in Turkish positive law will be discussed. In the third and last part, the rights and obligations arising from the relationship will be examined one by one in will be examined one by one in terms of individual labor law, collective labor law and social security law.
