The Brokerage in the contract of affreightments

ABSTRACT The diverse intermediaries act to engage cargoes to be carried by maritime line to ships that will transport these cargoes. One of these intermediaries is broker. The matter of the contract of affreightment is transporting of the cargo from one place to another place by maritime line. The brokers acting for the contract of affreightments join the parties of this contract of affreightment and they act as an intermediary. The parties of contract of affreightment need considerably to brokers that skilled about making of these agreements by causes of they generally stay in different places, not to know each other, not to know foreign language and laws of the country, not to have enough time and want to know continuously developing freight market The aim of this working is to investigate the activities of the brokers who are acting on contract of affreightment, their activities on affreightment markets, applied rules about them, obligations and responsibilities. In this investigation, the situation of this matter in English Law has also been explained. Essencially, because of application of Turkish Trade Law about broker who acting for the contract of affreightment the identification and elements of the trade brokerage has also been explained. Related with the brokerage, the conditions in the examples of charter-party has been investigated. However, because of abundance of types of charter-party examples, only a few examples has been stated and investigated about brokerage. VI
