Abstract (EN)

In this study, the financial dimension of crime approach within the scope of the policy of fighting against crime is examined. Also acknowledged as fight against proceeds of crime, this approach requires several instruments during the implementation process. Confiscation is one of these instruments, during the exertion of which, certain obstacles arise in Turkey. Given the fact that the scientific study of confiscation is rather limited and insufficient in Turkey, literature review has been made following the identification of the problem. The alternative confiscation methods in various countries has been analysed, evaluating their suitability, so as to overcome the troubles of implementation of confiscation in Turkey. In addition, although the discussions of human rights issues, especially on the implementation of alternative methods, occupies a significant position in the international academic literature, it has not been thoroughly studied in Turkey, which made it crucial to be referred to in this study, drawing the valid criteria within the frame of the European Court of Human Rights.
