Abstract (EN)

FREEDOM AND INDIVIDUALISTIC ARMAMENT FROM THE POINT OF SECURITY The basic purpose of the constitutional states, from the point of free and secure community, is to take human rights and democratic principles as a goal. On the grounds of legal arrangements and based on these goals, the citizens of these countries obtain individualistic arms, which cause some problems in regards to both freedom and security. The democratic rights of people to obtain arms that legal arrangements confer right of individual armament upon individuals, may sometimes threaten individual or public security such as; right to live, freedom of thought and expression, freedom of travel. When the arms that some people possess commence to hinder many people from using their rights, there arise some problems that ought to be solved by legitimate state. Human beings have established states to protect themselves from dangers coming from outside. The right to use violence has only been invested in the legitimate political governments. One of the reasons for establishment of the states and the basic duties of the politicians is to protect its citizens from the attacks that come from outside and inside. Accordingly, any political government, which has established its power, is expected to prevent occurrence of violence in the community. Armament of any individual or any group basing on the legal regulations and these arms that cause breach of freedom of any citizen or the community surely creates the notion of doubt as if the government is diverting from its fundamental purposes. Getting started from this doubt, the place of violence in human life, individual armament and violence relationship, freedom and security axis, the policies of the states and the supra-state actors and their armament policies have been investigated in this study, which consists of three sections. In the first section, violence, arms and crime interrelationship have been emphasized. In the second section, whether human beings are entitled to use weapons, which are a tool for violence, to protect their freedom or for their security. In the last section, compulsivity of armament in the stateless communities, collection of weapons from the people by the state for the reason of controlling violence, individual armament arrangements of the states and the armament of the policies of supra-state actors for individual armament have been analyzed. In the conclusion section, the destructive effects of individual armament on human life and measurements that have to be taken to prevent destruction.
