Public private partnership contracts in healthcare sector

Public private partnership model, which is commonly used in many countries to fulfill the investment needs of the public sector, is model in which risks and returns are shared between the public and private sectors through contracts. These contracts are subject to private law and known in the international literature as PPP Contracts. Even though the public private partnership model is mentioned in the Law No. 6428 regulating the structure of the build-lease-transfer model applied in the healthcare sector, it has been implemented since the 1980s and includes the build-operate-transfer, build-operate and transfer of operating rights models. Even though there has been several works aimed to regulate the public private partnership model and contracts concluded for the implementation of the PPP model, these works have not been enacted. Due to the extent of the subject, in our study, public private partnership contracts concluded for the implementation of the build-lease-transfer model applied in the healthcare sector in Turkey are analyzed and other public private partnership models are also mentioned. In this context, the scope, terms and results and termination of public private partnership contracts which set the terms of the construction, leasing and transfer of a project have been analyzed.
