Abstract (EN)

In order to provide the necessary protection to the policyholder, the duty to inform is regulated by special provisions. As in comparative law, the insurer's duty to inform is also regulated in our law. The duty to advise and counsel should be included in the insurer's duty to inform. Thus, the policyholder will benefit from a more comprehensive protection. Article 1423 of the Turkish Commercial Code and Article 11/3 of the Insurance Activities Code regulate the duty to inform. It is also regulated in detail by the Regulation Regarding Insurance Contracts about Information Obligation of the Insurers. However, the applicability of this regulations along with the provisions of the Turkish Commercial Code is doubtful. The foreseen differences in the consequences of the breach of the duty are analyzed.
