Responsibility of the civil aircraft operator

This study aims to examine the legal liabilities arising from passenger and baggage transportation activities carried out by civil airlines within the scope of both contractual liability and extra-contractual liability. The main objective of the study is to examine in detail the contractual liability of the carrier and the extra-contractual liability of the operator for the damages incurred by third parties and passengers arising from the operation of the aircraft.In the first part of the study, which consists of four main sections, the concept of civil air transportation is discussed in general terms; the definition of this type of transportation, its parties, its historical development and the basic responsibilities of the operators of civil aircraft are evaluated. In the second part, the legal liability of the carrier to the passenger within the scope of the contractual relationship within the framework of damages arising from civil air passenger transportation activities is analyzed. In this context, the provisions of national and international legislation and the obligations of the carrier regarding the legal status of the passenger or baggage and their legal nature are analyzed.In the third part, the liability of the operator within the scope of the legal relationship established between the carrier and the passenger arising from the operation of the civil aircraft, its legal nature and conditions are emphasized, and the liability of the persons who perform the act of transportation for the damages caused by third parties is evaluated. In the last chapter, the reasons that eliminate these responsibilities are evaluated, complementary to the substantive law aspects discussed in the previous chapters, and then proceeded to the procedural aspects of the proceedings. The types of proceedings, changes of parties, jurisdiction and competence of the courts, as well as procedural deadlines are discussed in the lihgt of national prodecural rules.
