Seizure of the industrial property rights

Industrial property rights, which are transferable and have an economic value, could be subject to the enforcement, attachment and end of the attachment it is possible to be concluded to encashment. Regulations of the industrial property rights don?t include specific articles about this procedure. This study analyzes the position of industrial property right in the seizure process and the details of this process. In this process, the relevant provisions of the Execution and Bankruptcy Law must be applied. Industrial property rights are the subject of this study examined the process of the seizure. This study consists of two headings. first heading ?the features of the trademark in the seizure?, which is the largest part of the study, gives general information about trademark, especially position of the trademark in the seizure process, and anlayzes legal effects of the bankrucpty, concordatum and postponemet of bankruptcy on the trademark. Features of the other industrial properties in the seizure process, patents and utility patents, industrial designs, integrated circuit topographies and plant breeder's rights are evaluated under separete sections in the second part of this study. In this study, legal status of the industrial property rights is generally evaluated on the specific subject of trademark. In the second section,other industrial property rights aren?t re- examined when all the features are same with the trademark in order to avoidrepeating. In addition to that topics, certain problems, which arise from practice of industrial property rights seizure rules, will be examined.
