Legal and criminal liability in case of infringement of trademark rights within the scope of Industrial and Property Law

The aim of this master's thesis is to address the legal responsibilities of the trademark owners and the criminal responsibilities of the persons who violate the trademark right in case of registration, protection and violation of the trademark right within the scope of the industrial and Property Law No. 6769. In the first part, where the general framework of the trademark right which constitutes the subject of the thesis work is discussed, it is observed that Turkey participated in many international conventions such as the Paris Convention of 1883 on the protection of the trademark right, WIPO founding convention, World Trade Organization. In addition, the elements of the definition of the trademark, the acquisition of the trademark, the reasons and types of the trademark rejection, the functions of the trademark, the types of the trademark and the stages of registration of the trademark are given. In the second section, the Industrial Property Law No. 6769 dated 10.01.2017 gives a more comprehensive structure to the industrial and property law, as opposed to the previous Khk which was put into effect on the protection of the trademark right, the protection of the trademark right, the violation of the trademark right and acts involving the violation of the trademark right and the. Accordingly, in case of acts involving infringement of the trademark right, legal responsibilities, legal measures and criminal provisions in the scope of Law No. 6769 are examined and the decisions and case law of the high courts related to cases opened within the scope of infringement of the trademark right are taken into consideration.
