A research on the effects of legislative arrangements to the prevention of division of agricultural lands with inheritance on greenhouse enterprises: Antalya provincial sample

Failure to maintain economic integrity of the agricultural land in the Inheritance Law regulations applied in Turkey, has adversely affected the sustainability of agricultural activities. Agricultural land and enterprise scales have become smaller with both inheritance and sales. There are many legal regulation realized for preventing this problem. The most comprehensive and latest regulation is the "Law on Soil Protection and Land Use No 6537" which is dated 2014. The aim of this study is to investigate the effects of the legal regulation (Law no. 6537) on the prevention of the division of agricultural land by inheritance and sales by means of a "producer attitude analysis" on the sample of Antalya agricultural enterprises. In the scope of the research; Aksu, Serik and Kumluca districts were determined as the research area, considering the density of the greenhouse production and the number of applications for heritage and sales purposes after the law. The survey was conducted with 88 greenhouse producers' face to face interviews that were chosen with snowball sampling Likert Type Attitude Scale was used for data analysis. As a result of the research; It is determined that the majority of producers have a negative attitude about issues such as indivisible land size limits, negotiated transfer options, proper heir criteria, inheritance and sale and approval of the Ministry of property transfer.
