Criminal liability arising from medical malpractice

The criminal liability of the doctors, express the responsibility of the doctors for the crimes they committed while performing their profession. Law rules have to be applied to everyone, and the doctors who cause the death or injury of the patient willfully or negatively will be tried within the framework of the law rules. The fact that the doctors are acting for treatment will not change the result. This risk exists within the sanctity of the medical profession. Because, it is essential that people trust doctors who perform a sacred duty and entrust their health. This will be possible by creating an effective justice system and understanding of responsibility. These issues are at the core of our research. In this research, the concepts of medical practice and medical error and the conformity of medical practices with law, consent, medical necessity, the fulfillment of medical practice in accordance with the obligation of care, the criminal liability of the doctors will be explained in detail. In this research, the concept of medical error, consent, complication and the concept of criminal liability of the doctor will be explained and the criminal responsibility and irresponsibility of the doctor will be explained in detail. In our study, besides the Turkish Legal System, the systems applied in various countries will be mentioned and the history of responsibility arising from doctors' errors will also be mentioned. In our study, doctor offenses were also tried to be explained through the investigation and prosecution procedure.
