Abstract (EN)
Terrorism, used as a strategy to achieve political goals, causes losses in the personal and property assets of civilians and public officials. One of the areas where states today deal with terrorism is the problem of how to compensate these losses. There are a number of programs developed by states to support victims of terrorism. In our country, there are some ways in which the State is involved to compensate for these losses. In this study, these ways, called judicial and administrative methods, are tried to be revealed and the patterns formed by judicial practice between these methods are tried to be determined. In addition, developments in international and comparative law regarding the support of victims of terrorism and their impact on our domestic law were examined. Again, issues related to terrorism itself have been given as much space as necessary, as they feed the main theme. All of this has been done by scanning domestic and foreign sources and especially numerous decisions regarding judicial practice. These studies and investigations have reached the conclusions that supporting victims of terrorism through methods involving the State in compensating for their losses reflects the common sense of justice of human family, that the framework of the social risk principle should be re-established in accordance with the Constitution, and that a number of legal and structural reforms are needed for the implementation of Law No. 5233.
