Abstract (EN)

The main idea of this study is to emphasize the relation between society and law in the context of public conscience and the necessity of the harmony of law and public conscience. Therefore it is important to clarify the term of "conscience". Conscience, which has thousands of years of history and accumulation, has been handled by various approaches. Within these approaches the term of conscience is handled using individualistic aspect. However the requirement of living together as a society has revealed the term of "public conscience". Conscience has a close relation with law. However, in historical process this relation has been damaged and the purpose of ensuring justice, which is the primary purpose of law, has been neglected and law has been confined within the definition of "the rules regulating society". The harmony of law and the public conscience is so important for a peaceful society. In this study this importance is clarified using precedents and the public reaction against these precedents.
