Effective remorse in Turkish criminal code

In the study, the institution of effective remorse in Turkish Criminal Law is discussed and conceptual, historical and practical explanations are made about this subject. The aim of the study is to create an up-to-date, explanatory and instructive resource about the effective repentance institution. The study consists of three main chapter titles. In the first part, the concept of active regret, its historical development process and its legal nature are discussed under the title of the general principles of effective regret. In the second part, the elements of effective remorse regarding the act and the perpetrator are explained separately and its relationship with similar penal institutions such as voluntary renunciation and plea bargaining is examined. In the third part, the place of effective repentance in our legislation is explained separately in terms of other special penal laws such as 5237 numbered Turkish Criminal Code and 5271 numbered Criminal Procedure Code, 5941 numbered Check Code and 5607 numbered Smuggling Code. These explanations have been supported by current law amendments, different views in the doctrine, Court of Appeal and Constitutional Court decisions.
