Abstract (EN)
Offense of Libelaims at preserving personal honor and dignity. Therefore, in the eight chapter of these condsection of the Turkish Penal Code, called "Offenses Against Persons", it is regulated as "Offenses Against Persons", it is regulated as "Offenses Against Honor" in the article 125 and successive ones. Turkish Penal Code, No:5237 has significiant differences from Turkish Penal Code, No: 765 in terms of offense of libel. One of these differences is also the abolishment of the distinction of "libel" and "swear". In democratic legal systems, persons shave the right of expression. Criticisim and satire are also in this content. Yet, there is also a limit to the right of expression. Therefore, the balance in between the right of libel has constituted the theme of many decisions of European Court of Human Rights.
