Abstract (EN)

Fraud, which is one of the crimes committed against property within the scope of the repealed TPC and TPC numbered 5237, is an act of obtaining unfair advantage by committing fraudulent actions that will cause the victim's will power disability. Within the scope of our study, the regulations of the fraud crime in different countries, its comparison with some other crimes and misdemeanors, the basic elements of the crime and its qualified forms have been examined and evaluated. While there is no systematic regulation regarding the qualified cases of the fraud crime within the scope of the TPC, it is seen that the intent of the perpetrator in some qualified cases, the means used by the perpetrator as a tool in committing the crime in some cases, and the position and qualification of the victim in some cases. Therefore, in our study, it is also possible to evaluate the qualified forms of fraud crime in this direction. In addition, cases that require the trial procedure of fraud crime, personal impunity and reduction of punishment are also examined within the scope of our study.
