Abstract (EN)

The thetf crime that can be defined as taking away a movable property belonging to someone else from its place in order to benefit without concent of the proprietor is involved in chapter of crimes aganist property of Turkish Criminal Code. In the Thesis, while exlaining about the theft crime, Turkish Criminal Code No:5327 and later modifications on this code in addition to brought amendments are mentioned. Explanations about amendments and modifications are related to both theft crime and genaral provisions.The Turkish Criminal Code No:765, the one of the fundemental laws of Turkish Republic history, was abrogated during the accession of European Union and entered into force in 2005. Turkish Criminal Code no:5237 brings important changes about general crime theory and spesific provisions, but with the comparision of previous adjustments, the radical amendments about elements an efficiency of this crime haven?t been made.This Thesis has three parts and a conclusion.The first chapter includes definititon of the theft crime, comparisons of similar crime types in the same chapter on the code and the elements of the crime.In the second chapter, qualified circumstances and sanctions of this crime will be explained.In the third chapter, criminal attempt, accesory to the crime, concurrence of crimes and procedural provisions are analysed.In conclusion, in the last chapter is completed with the general evaluation of theft crime.Key words: Crimes aganist property, theft crime, movable goods, elements of the theft crime, criminal attempt to the theft crime.
