Abstract (EN)

In the globalizing world, as in every field, some important developments have occurred in the field of tourism sector in recent years. In our country, the quality of people's holiday needs has changed over the years. Time share vacation systems appear as the most important tourism practice that emerge in line with the needs of individuals. There are time share vacation types in the Turkish law that provide people the right to have a limited time advantage. While some of these contracts provide real rights to the beneficiary, some of them provide personal rights are the ones that find the most common practice area in our country. Among the contracts that provide personal rights, time share contracts are the most common type in practice in the strict sense. Both types of contracts are specially determined by the lawmakers in our law with legal regulations, and the time share contracts first took their place in our law with the Law No. 3227 on the Addition of Articles Related to Time Share Right to the Property Ownership Law. The rights and obligations of the parties have been further elaborated compared to the old-dated regulations with the innovations introduced in the scope of the Law No. 6502 on the Protection of the Consumer regarding the time sharing and time share property contracts. Within the framework of the innovations brought by the law, it is aimed to make the applicability of the mentioned contracts more reliable and make them contribute to the development of the tourism sector. In our study, time share property and time sharing in the strict sense were examined in detail. The purpose of our study is to examine the time share property and time share vacation contracts, the relevant determining and complementary elements, the opinions included in the doctrine and the Supreme Court decisions, and to clarify in terms of the parties the innovations brought within the scope of the Law no. 6502 on the Protection of the Consumer, by comparing them in line with the provisions of the Law on the Protection of the Consumer.
