Abstract (EN)

XV MILITARY INSTALLATION IN TURKISH LABOR LAW (ABSTRACT) Military installations are included in the places where labor law is fully applied. In this context, the defination of bussiness in the labor law is also valid for the military installations, one of the differences in the labor law concerning the military installations is that laborar determines the sector in which the business is as opposed to the nature of the work in other sectors. Another difference is that strike and lock out is forbidden in the military installations which are ran directly by the ministey of defense, gendermarie and the cost guard. Also the law stimulates that the inspections of the military installations are conducted by the military inspectors. In the military which is charecterized by a strict hierarchy the service commands are the most important units which have decision making authority and they are authorized to conduct collective bargaining. Turkish military law defines workers.who work in military installations as limited military personel and is subjected them to the authority of the superiors. In this capacity they are under the jurisdiction of the military courts and the disipline courts. The union membership in the military installations, where there is no restrictions in terms of individiul and collective rights to join a union, is higher then the national standart. Although it is limited, there are some restrictions in the collective bargaining process, strike and other actions are prohibited in the military installations to preserve the readines of the military which is essential for the security of the nation. Besides collective bargaining other rights to participate in the managament are granted to the workers working in the military initiations. But the right to participate in the manegement is limited to consultation.XVI Since the military requires confidentiality and security the laws require that the inspections be conducted by the military personel.
