Abstract (EN)

The thesis study with title "The Termination Contract at the Turkish Labor Law and the Supreme Court Practices" includes the examination of the termination contract which is mainly applied in the Turkish Labor Law, the establishment and validity conditions of this contract, point of view of the Supreme Court to this subject, and the examination of the criteria developed by the Supreme Court about the termination contract. The reason of writing this thesis is to reveal the matter in which conditions it is valid in case of termination of the labor contract with the termination contract. For this reason, we discuss the case law of the Supreme Court related to the subjects with the opinions in the discipline. It is possible for parties to terminate present work relationship between each other upon agreement within scope of inclusion of freedom to terminate the contract. However, because the Labor Law includes the rules for protection of the worker, in the event labor contract is terminated with the termination contract, the importance to legally examine the termination contract made because of results, gains and losses. Because said study is not issued in our legislation, we try to examine by taking into consideration the opinions in the discipline and the case law of the Supreme Court. We examine the scope of the termination contract in this scope, and we try to examine the termination contract at the labor law and the Supreme Court practice related to this contract.
