Abstract (EN)
In this study, applying the legal right of preemption in the Turkish Civil Code to trademarks is examined. The study consists an introduction, three sections and a conclusion part. The right of preemption and trademark were handled separately and the application of this right on the trademark was studied. The legal preemption right of the Turkish Civil Code for the immovable property and the Industrial Property Code for the trademark were compared. On the application of the right of legal preemption on the trademark joint ownership, the preemption event, the claim of the right to legal preemption and the results of the exercise of the right has been explained. Controversial issues have been mentioned and considerations have been made in terms of the law.
