Abstract (EN)
Patients' rights in the twentieth century the world has experienced an intense development. Physicians or other health service staff will provide patients, international documents have been taken under protection. Turkey also affected by these developments and initiatives launched in this regard. In 1928, "and Tababet Arts Style-i-i Executive Şuabat The law", in 1961, "Medical Deontology Regulation" and in 1998 the "Regulation on Patients' Rights" was published. Indeed, 56 of our Constitution Article 3 paragraph, the state, everyone's life, physical and mental health is required to ensure continued within indicated. The state of health services facilities to the extent permitted himself to offer public services such as through the private sector also able to walk. In addition, the new Turkish Penal Code No. 5237 of the rights guaranteed to patients with the new regulations were introduced.Health services, in person, established by the State of public hospitals, public personnel status in the case presented by physicians, the public service will be considered and will be subject to the principles of administrative law. Therefore, this violates the rights of patients by physicians, in the case of damage, defects within the scope of services such damage will be compensated by the administration.Or self-employed physician in private hospitals, while health care providers to violate the rights of patients in the event that the responsibility is born. Believe has been a violation of patient rights and / or close to the patient's right to administrative and legal ways can call. In this study, Turkey and the international patient's rights documents, historical development, health institutions, health workers, professional organizations, expert institutions and individuals in the community of other patients' rights in terms of responsibilities, by scanning in Turkey a patient and / or the patient's right to close which means how to search information collected has been examined and re-evaluated.Key Words: Patient rights, patient rights and relevant international documents, medical staff responsibility, the responsibility of health institutions, health-related expert institutions, professional organizations related to medical, liability, medical administrative law, medicine, criminal law.
