Efficiency of judicial review of administration in Turkey

There are various controlling ways of public administration. Although different mechanisms can be used to control public administration, it has been explained the effectiveness of judical control and focused on judicial control of public administration in this thesis.The concept of judicial review of public administration means the controlling of of all kinds of acts and proceedings of administrative authorities by administrative courts. Decisions of administrative authorities are gaining importance more and more in social life and the concepts of transparent administration and governance are becoming dominant values in public sphere by communication revolution. Individuals are willing to participate in decision-making process related to them and their environment. In short a critical culture is deepening in our social life. As a result, in order to control objectively and impartially taking of administrative decisions or acts and proceedings thought to be violating the rights of the individuals to the administrative courts is becoming the norm. In this process it is very important the impartiality and objectivity of the system especially in terms of individuals esappealing to judicial outhorities.In this study judicial control of public administration, its progress in historical process, institutional developments and its place in current legal system, the factors reducing the effectiveness of judicial control of public administration are explained in turn.The study consists of three chapters. The first one includes conceptual analysis. The second one presents the the concept of rule of law in terms of our legal system and the historical process of judicial control of public administration which is important part of rule of law. In the presentation the history of this concept is discussed from Ottoman Empire to the Turkish Republic. The third one focuses on the concept of effectiveness of judicial control of public administration. The last one mentiones ineffective aspects of existing administrative jurisdiction system and also includes solutions.Key Words:rule of law, public administration, control, judicial control, effectiveness.
