Abstract (EN)

Surrogacy, one of the assisted reproductive techniques, is an area where reproduction is transformed into production and structured globally, and it takes place in the form of women who cannot bear children by renting the wombs of other women. With surrogacy, the basic constitutive norms of patriarchy such as motherhood, fatherhood, family, and the language of these concepts have also been deconstructed. Because it is accessible to women with a certain economic status through transnational capital, and because the surrogate mother does not have this economic status, it allows an unequal, capitalist sexist order of exploitation to operate. Although it breaks patriarchy in many ways, it reconstructs and reproduces concepts such as motherhood and family. In this study, which is conducted within the framework of the question "Where does surrogacy fall sociologically?", surrogacy deals with motherhood produced within the fiction of patriarchy, and based on the fact that the female body is commodified, controlled, regulated and shaped, it can be said that it raises various issues of the right to property, the right to life, women's rights, and children's rights, whose legal framework is not clear. This study has shown that both surrogate mothers and voluntary parents are under social pressure. It also discusses the impact of reproductive technologies on pregnancy, motherhood, and the family, and the potential for life to begin in a tube or a laboratory and continue with a technology that extends to artificial womb facilities. These technological developments, in which IVF treatments represent a very important break, are now moving towards a formation such as disembodied motherhood. This study discusses two different concepts such as fragmented motherhood for voluntary motherhood and buffer motherhood for surrogacy and proposes concepts such as legal father and formal father for fatherhood. This conceptual proposal aims to show that surrogacy, as a reproductive technology, transforms deconstructed concepts., as a reproductive technology, transforms deconstructed concepts. In surrogacy, women experience alienation from their wombs and the fetuses they carry, while the child to be born may have more than one parent. This situation, which should be considered in terms of the best interests of the child, has the potential to create inequality among children. For this very reason, surrogate mothers, voluntary parents, and the dignity and rights of the child should be addressed from an equal and fair perspective in this area where transnational capital operates.
