The right to benefit from defender assistance in criminal procedure law in the light of judicial decisions

In order for fair trials to be set in criminal proceedings, resulting from a suspicion of a committed crime, and joint studies in the form of allegations, defense and trial, the right to defend oneself should be ensured, its efficiency shall be granted and be subject to no restriction. In this sense, the right to benefit from counsel assistance within the scope of the right of defense manifests as a solid reflection of the right of a fair trial. In the face of a criminal charge in criminal proceedings, the suspect and the accused must have the right to benefit from advocacy assistance so that they can be judged fairly and exercise their right of defense effectively. In this respect, benefiting from the defense assistance of the suspect and the defendant will remove the inadequate and disruptive aspects of individual defense, enable the equality of arms and contradictory trials against the prosecution who possesses public power. In this study, the importance of the right to benefit from advocacy assistance in terms of right to fair judgment and defense, the historical development and legal status of the advocacy institution, the arrangement of the right of advocacy assistance in national and international legal documents, the ways of benefiting from advocacy assistance, the powers and duties of the advocate are examined in the light of judicial decisions, trying to set forth suggestions.
